Welcome to RealEstate CRM CRM. By accessing or using our Customer Relationship Management (CRM) platform and services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms apply to all users of the Services, including administrators, managers, and sales personnel within your organization.

2. Description of Services

RealEstate CRM CRM provides a cloud-based real estate lead management platform that includes:

  • Lead capture and management from multiple sources
  • Integration with property portals and social media platforms
  • Team collaboration and lead assignment tools
  • Follow-up scheduling and reminders
  • Property listing management
  • Reporting and analytics
  • Notification services (email, push notifications)

3. Account Registration and Security

3.1 Account Creation

To use our Services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the accuracy of your account information.

3.2 Account Security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must notify us immediately of any unauthorized access or security breach.
  • You are responsible for all activities that occur under your account.
  • We recommend using strong passwords and enabling additional security measures when available.

3.3 Organization Accounts

If you create an organization account, you represent that you have the authority to bind that organization to these Terms. The organization administrator is responsible for managing user access and permissions within the organization.

4. Acceptable Use Policy

You agree NOT to use our Services to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload or transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems or other user accounts
  • Interfere with or disrupt the Services or servers
  • Scrape, harvest, or collect data from our platform without authorization
  • Send spam or unsolicited communications to leads
  • Misrepresent your identity or affiliation
  • Store or transmit any content that is illegal, defamatory, or harmful
  • Use the Services for any fraudulent or deceptive purposes
  • Resell or redistribute the Services without our written consent

5. Data Ownership and Rights

5.1 Your Data

You retain ownership of all data you input into the Services ("Your Data"), including lead information, customer records, and communications. You grant us a limited license to use, process, and store Your Data solely to provide the Services.

5.2 Our Platform

We retain all rights to the Services, including software, design, features, and documentation. These Terms do not grant you any intellectual property rights in our platform.

5.3 Feedback

If you provide feedback or suggestions about our Services, we may use them without any obligation to compensate you.

6. Third-Party Integrations

6.1 Facebook Integration

Our Services integrate with Facebook Lead Ads. By connecting your Facebook account, you:

  • Agree to comply with Facebook's Platform Terms and Policies
  • Authorize us to access your Facebook pages and lead data
  • Acknowledge that Facebook's data is subject to their Privacy Policy
  • Understand that you can revoke access at any time

6.2 Property Portal Integrations

Integration with property portals (99acres, MagicBricks, Housing.com, etc.) is subject to those platforms' terms and conditions. We are not responsible for data accuracy or availability from third-party sources.

6.3 Third-Party Services

Our Services may integrate with or link to third-party services. We are not responsible for the practices or content of third-party services.

7. Service Availability and Support

7.1 Availability

We strive to maintain high availability of our Services but do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, updates, or factors beyond our control.

7.2 Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time. We will provide reasonable notice for material changes when possible.

7.3 Support

Support is provided through email and in-app channels during business hours. Response times may vary based on the nature and priority of the issue.

8. Payment Terms

8.1 Fees

Fees for the Services are as agreed upon during registration or as specified in your subscription plan. All fees are exclusive of applicable taxes unless stated otherwise.

8.2 Payment

Payment is due as specified in your subscription terms. Failure to pay may result in suspension or termination of your access to the Services.

8.3 Refunds

Refunds are provided only as specified in your subscription agreement or as required by law.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be error-free, secure, or uninterrupted, or that any defects will be corrected. You use the Services at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALESTATE CRM AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Our total liability for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless RealEstate CRM, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Termination

12.1 By You

You may terminate your account at any time by contacting us. Upon termination, you will lose access to the Services and Your Data.

12.2 By Us

We may suspend or terminate your access to the Services at any time for violation of these Terms, non-payment, or any other reason at our discretion. We will provide notice when reasonably possible.

12.3 Effect of Termination

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will remain in effect (including Sections 5, 9, 10, and 11).

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RealEstate CRM regarding the Services.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of the modified Terms.
